29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i): The employer does not each employee working in excavations from cave-ins by an adequate protective system. This violation was observed on or about September 4, 2013, at the excavation site where an employee was exposed to struck-by and crushed-by hazards when working in an excavation that was not protected from a cave-in on the end wall of the excavation near the ladder. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from cave-ins by an adequate protective system.
