29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:     On or about 9/4/2013, the employer did not ensure employees were protected from falling into an approximately 9 foot deep storm water separation pit when performing cleaning operations of the separation systems mechanical equipment.  Approximately three times per week an employee must enter inside the guardrails surrounding the pit to clean the skimmer and other mechanical equipment used to clean the storm water.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:     On or about 9/4/2013 the employer did not conduct annual periodic inspection of energy control procedures of the machinery to include; two bailers, shear, oil skimmer, skid steer, two forklifts, tire machine, two wire strippers, tire machine, diesel tank, hydraulic tank, and an air compressor, at their yard #2 facility.

On or about 9/4/2013 the employer did not ensure a Quality Products International, Inc. Down Stroke Bailer, Model V-6030-M, Serial No. 9711L4G6 was guarded to prevent employees from reaching into the exposed point of operation.    b.      On or about 9/4/2013the employer did not ensure a J. McIntyre Machinery, LTD  Shear, Model 320, Serial No. 1476 guard was properly adjusted to prevent employees from reaching into the exposed point of operation.
