Employees working in the treatment room were exposed to falls into the tank when loading/unloading materials in the tank.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Norlake Manufacturing Company - Elyria, Ohio: On or about September 10, 2013, the employer failed to obtain approval from the forklift manufacturer before adding a counterweight to the Clark forklift (model GCX50; s/n GX710U-0065-9418FB). The addition exposed employees to tip-over hazards and was used to gain additional forklift capacity.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) Norlake Manufacturing Company - Elyria, Ohio: On or about September 10, 2013, the employer did not assure the Clark forklift (model GCX50; s/n GX710U-0065-9418FB) was removed from service during a time in which the horn was not operational, exposing employees to struck-by hazards. b) Norlake Manufacturing Company - Elyria, Ohio: On or about September 10, 2013, the employer did not assure that the Bendi forklift (model B30E180D; s/n B30-702G-00342) was removed from service during a time in which it was not in safe operating condition. Employees were exposed to injury from falling loads in that the lift presented a hydraulic leak.
