29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training, and periodic inspections to ensure that before any employee performed servicing or maintenance on a machine or equipment where the unexpected energizing, startup, or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:     Instance 1: On or about 09/12/2013, in the Shredder Building, the employer did not establish a lock-out/tag-out program, which included procedures and training, for employees tasked with cleaning the magnet and shaker; industrial machines were not locked or tagged out during cleaning.     Instance 2: On or about 09/12/2013, in the Production Plant and Shredder Building, the employer did not establish a lock-out/tag-out program, which included procedures and training, for employees tasked with changing the blades on the shredder, oiling the gear boxes, and maintaining the belts and roll mills; industrial machines were not locked or tagged out during aforementioned maintenance.

29 CFR 1910.157(e)(3): Portable fire extinguishers were not subjected to an annual maintenance check:    Instance 1: On or about 09/12/2013, in the Office Building, the employer did not ensure that the portable fire extinguishers mounted to the walls were each subjected to an annual maintenance check.  The last annual maintenance checks were performed in 08/2012.     Instance 2: On or about 09/12/2013, in the Production Plant, the employer did not ensure that the portable fire extinguishers located throughout the building were each subjected to an annual maintenance check.  The last annual maintenance checks were performed in 08/2012.      Instance 3: On or about 09/12/2013, in the Shredder Building, the employer did not ensure that the portable fire extinguisher was subjected to an annual maintenance check.  The last annual maintenance check was performed in 08/2012.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck:     On or about 09/12/2013, the employer did not ensure that each forklift operator had successfully completed the training to be a certified powered industrial truck operator per the aforementioned training requirements, prior to allowing them to operate a forklift.
