The employer did not establish a written bloodborne pathogens exposure control plan to eliminate or minimize employee exposure.

29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employee exposure: a) During the period of May 1, 2013 through September 11, 2013, at the above located workplace, employees were required to work with Exel International, Hypodermic Needles (25 G x 1 inch). These needles did not have engineered sharps injury protection, and placed the employees at an increased risk of needle sticks. Effective and appropriate sharps with engineered sharps injury protection were commercially available. Employees using the syringes and needles without engineered sharps injury protection were therefore exposed to the hazards associated with blood borne disease.

29 CFR 1910.1030(f)(1)(ii): The employer did not ensure that all medical evaluations and procedures including the Hepatitis B vaccine and vaccination series and post-exposure evaluation and follow-up, were provided as required by 1910.1030 (f)(1)(ii)(A) through 1910.1030 (f)(1)(ii)(D): a) During the period of May 1, 2013 through September 11, 2013, at the above located workplace employees were required to work with blood while giving injections . The employer had not provided all employees a free Hepatitis B vaccination series according to recommendations of the U.S. Public Health Service current at the time the evaluation and procedures took place.
