29 CFR 1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes.  (a)    For employees working in the frozen foods department at 8424 Sheldon Road,Tampa, FL 33615, as noted on or about 09/11/2013.  The employees handle products which are maintained at 0-5 degrees Fahrenheit. The  protective gloves provided were not sufficiently insulating employees' hands from the cold surfaces. The lack of proper gloves had resulted in employees losing feeling and experiencing numbness in their hands.  Additionally, the two sizes offered (large and extra-large) did not fit the hands of all employees.

29 CFR 1910.132(d): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which would have necessitated the use of personal protective equipment:  (a)    For the frozen foods department at 8424 Sheldon Road,Tampa, FL 33615, as noted on or about 09/11/2013.  A personal protective equipment assessment had not been conducted for employees handling frozen foods for extended amounts of time. The lack of an assessment resulted in employees having neither the proper gloves nor the proper sizes to provide adequate thermal protection.
