29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: The employer does not ensure that a monitoring program is developed and implemented for the following: a) A grinder operator was exposed to continuous noise levels at 69.5% of the permissible daily noise exposure or an equivalent sound level of approximately 87.3 dBA during the 478 minute sampling period on 9-17-13; exposure calculations included a zero increment for the 2 minutes not sampled. b) A welder was exposed to continuous noise levels at 88.7% of the permissible daily noise exposure or an equivalent sound level of approximately 89.1 dBA during the 484 minute sampling period on 9-17-13. c) A pipefitter was exposed to continuous noise levels at 66.1% of the permissible daily noise exposure or an equivalent sound level of approximately 87 dBA during the 485 minute sampling period on 9-17-13. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a monitoring program is developed and implemented.
