Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by bullets or projectiles:  a) Rifle Test Range, Henry RAC Holding Corporation, 59 East 1st Street, Bayonne, NJ, 07002.  1. On or about 9/19/2013, an employee and engineer entered the facility's unsecured firing range with the manufacturer's new prototype 44.40 caliber rifle.  The employee was left unsupervised while the engineer went to retrieve the proper ammunition.  When in the range alone, the employee obtained a 45 caliber round from the unsecured ammunition left in boxes at the range.  The worker attempted to chamber the wrong caliber round using the feed lever repeatedly.  During that time, the employee accidentally discharged the jammed round through the open chamber with the weapon reversed over his forearm.  Fragments from the shell casing lacerated and were imbedded in the worker's left forearm with the lead slug jammed part-way down the smaller caliber barrel.  2. On or about 10/25/2013, ammunition and firearms was stored in an unsecured manner, where employees from other work areas could enter the firing range without management supervision.  The security gate itself was left open and even when magnetically locked, there was a large enough opening in the gate to reach through from the outside and press the unlock button to allow unauthorized entrance to the firing range.  In addition, there were unsecured boxes of ammunition located throughout the firing range and warehouse area.  3. On or about 12/5/2013, two live 44.40 rounds were found inside a BTH prototype 44.40 caliber rifle during its disassembly outside of the firing range area.   4. On or about 12/12/2013, an engineer was performing a BTH handling demonstration for a worker, when the weapon discharged into the exterior wall of the firing range.

29 CFR 1910.36(d)(1): Employee(s) were not able to open an exit route door from the inside at all times without keys, tools, or special knowledge:  a)  Left fire exit facing back of warehouse, Henry RAC Holding Corporation, 59 East 1st Street, Bayonne, NJ 07002.   The employer installed a locked sliding gate in front of an emergency exit door.  During a fire or other emergency, workers would not be able to utilize the exit door.   Condition noted on or about 10/25/2013.
