29 CFR 1910.219(d)(1): Pulleys, any parts of which are seven (7) feet or less from the floor or working platform, were not guarded in accordance with the standards specified in paragraphs (m) and (o) of this section: a) On or about September 24, 2013 and times prior, employees were exposed to injury from being caught in the rotating pulley that drives the bucket leg on the queen bean bin. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet"). Midland Bean was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.219(d)(1), which was contained in OSHA inspection number 313720732, citation number 1, item number 9a and was affirmed as a final order on October 3, 2011, with respect to a workplace located at 489 West Hwy 491, Dove Creek, CO 81323.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: a) On or about September 24, 2013 and times prior, employees were exposed to illnesses in that, the employees were required to wear tight fitting respirators prior to being annually fit tested.
