29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: On or about September 25, 2013, at the Center Stone Apartment Complex Phase II worksite, 2275 Moix Boulevard in Conway, Arkansas, east side of Building #34, employee elevated in a United Rentals S-45 extensible boom lift, s/n 1068689, did not wear fall protection while performing exterior siding installation. This condition exposed employee to tip-over and falls from elevation.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about September 25, 2013, at the Center Stone Apartment Complex Phase II worksite, 2275 Moix Boulevard in Conway, Arkansas, for the benefit of employee elevated in a United Rentals S-45 extensible boom lift on the east side of Building #34, the employer did not ensure employee was able to recognize, avoid and minimize potentially hazardous conditions associated with falls from elevated lift baskets. Employee was allowed to work in an elevated lift basket without the use of a safety harness and lanyard to protect against tip-over and falls.
