29 CFR 1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel: Located along the front area of the residential structure an employees was observed working from a bundle of OSB sheeting placed on the elevated forks of a JLG-G6-42A rough terrain industrial truck (forklift) and was not protected by secured guard railed safety platform or equivalent and was exposed to fall potentials in excess of 23 feet.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. A forklift operator who was not trained on the workplace hazards associated with forklift operation and requirements of this regulation elevated a JLG-G6-42A rough terrain industrial truck (forklift) mast/forks with attached bundle of OSB sheeting placed on the elevated forks on which an employee was allowed to work from which was not protected by a secured guard railed safety platform or equivalent.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Located along the front area of the residential structure employees were observed performing framing associated truss alignment, roof sheeting layout and roof sheeting operations without conventional fall protection from perimeter exterior stud wall top plates and were exposed to fall potentials in excess of 20 feet. Elizabeth Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29CFR1926.501(b)(13), which was contained in OSHA inspection number 315435594, citation number 1, item number 1 and was affirmed as a final order on (3-23-2011), with respect to a workplace located at 10105 Benham Dr, Centerville, OH 45459.
