29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service: On or about October 23, 2013, and times prior thereto, five masonry employees were using personal fall arrest system that were not inspected before use, and/or defective components were not removed from service. These conditions exposed employees to fall hazards.

29 CFR 1926.95(d)(1): Protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employees. On or about October 23, 2013, and times prior thereto, employees working for Belt Con Construction, Inc. were asked to buy their own safety equipment that include but not limited to personal fall protection equipment system, safety glasses, gloves. This condition exposed employees to safety and health hazards, due to lack of maintenance and inspection before use of personal protective equipment.
