On or about October 21, 2013, at the construction site, employees engaged in framing activities were not provided a ladder for access to the second level exposing employees to fall hazards of approximately 9 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about October 21, 2013, on the south side of the construction site, an employee was exposed to a fall hazard of approximately 9 feet while engaged in framing activities on a residential home. MR. LEONCIO AVILA WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(b)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 854583, CITATION NUMBER 1, ITEM NUMBER 002 AND WAS AFFIRMED AS A FINAL ORDER ON MARCH 13, 2013, WITH RESPECT TO A WORKPLACE LOCATED AT 3532 TEXAS STAR, FORT WORTH, TEXAS 76103.
