Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. On or about October 23, 2013 - at the above addressed jobsite, an employee performing roofing operations approximately twenty one (21) feet above the ground was not protected from falls, thereby exposing the employee to fall hazards.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided. a. On or about October 23, 2013 - at the above addressed jobsite, the employer was using a pump jack scaffold as means of access to the roof and was exposed to falls of more than ten (10) feet from the open sides of the pump jack scaffold, thereby exposing the employee to fall hazards.
