29 CFR 1910.134(d)(1)(iii): The employer shall identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH: a. On or about December 26, 2014, at the above addressed jobsite, an employee cutting siding (HardiePlank) with a circular saw (DeWalt, DWE575) was exposed to the respiratory hazards associated with silica due to not evaluating the respiratory hazard(s) at the worksite. b. On or about January 12, 2015, at the above addressed jobsite, an employee cutting siding (HardiePlank) with a circular saw (Ridgid, R3401) was exposed to the respiratory hazards associated with silica due to not evaluating the respiratory hazard(s) at the worksite.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following: a. On or about December 26, 2014, at the above located jobsite, an employee cutting siding (HardiePlank) with a circular saw (DeWalt, DWE575) was exposed to the hazards associated with chemicals such as, but not limited to silica. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) will be met. b. On or about January 12, 2015, at the above located jobsite, an employee cutting siding (HardiePlank) with a circular saw (Ridgid, R3401) was exposed to the hazards associated with chemicals such as, but not limited to silica.
