OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards:  a)  Throughout facility and yard;  On or about October 22, 2013 and at times prior thereto, the employer exposed his employees to struck-by and crushed-by hazards in that employees were permitted to operate powered industrial trucks without wearing and being required to wear seatbelts.

29 CFR 1910.147(e)(3): Specific procedures and training that were developed, documented and incorporated into the employer's energy control program for removal of a lockout or tagout device under the direction of the employer when the authorized employee who applied the logout or tagout device was unavailable were not developed:  a)  Throughout the facility;  On or about October 22, 2013 and at times prior thereto, the employer exposed employees to potential hazardous energies in that the employers written lockout tagout program did not contain specific procedures and training on the removal of a lockout or tagout device by a person other than the authorized employee who applied the lockout device.  All lockout devices could be opened by the same key.

29 CFR 1910.215(a)(4): Work rest(s) on grinding machinery were not adjusted closely to the wheel with a maximum opening of one eighth inch:  a)  Maintenance Shop;  On or about October 22, 2013 and at times prior thereto, the employer exposed his employees to struck-by hazards in that employees were allowed to operate a 6" DeWalt brand bench grinder with the work rest adjusted greater than 1/8" from the grinding wheel.

29 CFR 1910.215(b)(9): Guard for abrasive wheel machine where the operator stands in front of the machine was not constructed so that the peripheral protecting member could be adjusted to the constantly decreasing diameter of the wheel:  a)  Maintenance Shop;  On or about October 22, 2013 and at times prior thereto, the employer exposed his employees to struck-by hazards in that employees were allowed to operate a 6" DeWalt brand bench grinder with the tongue guard adjusted greater than 1/4" from the grinding wheel.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one half hour:  a)  Maintenance Shop;  On or about October 22, 2013 and at times prior thereto, the employer exposed his employees to fire hazards in that employees were allowed to walk and work in the same area where oxygen cylinders were stored within 16" of fuel gas cylinders (acetylene) without a barrier as required by the standard.
