OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employees were exposed to excessive heat: a) 4290 Alatex Road (Plant 2); On or about September 3, 2014 and at times prior, employees engaged in recycling activities inside a metal building were exposed to the hazard of excessive ambient heat (heat index average 108 degrees Fahrenheit, heat index maximum 120 degrees Fahrenheit) from factors such as but not limited to solar heat, grinder machines and other machines that are used to melt plastic.
