29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. On or about October 25, 2013, an employee who was working in the production area was exposed to noise levels at 122.4% of the allowable 8 hour time weighted average sound level (85 dBA). The equivalent level of the 122.4% is approximately 91.5 dBA which is capable of causing permanent hearing loss. The sampling was performed for 478 minutes during one work shift on October 25, 2013. The noise level exceeded a dose of 50% and no hearing conservation program was in place at the time of the exposure. b. On or about October 25, 2013, an employee who was working in the production area was exposed to noise levels at 100.5% of the allowable 8 hour time weighted average sound level (85 dBA). The equivalent level of the 100.5% is approximately 90.2 dBA which is capable of causing permanent hearing loss. The sampling was performed for 471 minutes during one work shift on October 25, 2013. The noise level exceeded a dose of 50% and no hearing conservation program was in place at the time of the exposure. c. On or about October 25, 2013, an employee who was working in the production area was exposed to noise levels at 89.7% of the allowable 8 hour time weighted average sound level (85 dBA). The equivalent level of the 89.7% is approximately 89.5 dBA which is capable of causing permanent hearing loss. The sampling was performed for 467 minutes during one work shift on October 25, 2013. The noise level exceeded a dose of 50% and no hearing conservation program was in place at the time of the exposure. d. On or about October 25, 2013, an employee who was working in the production area was exposed to noise levels at 84.3% of the allowable 8 hour time weighted average sound level (85 dBA). The equivalent level of the 84.3% is approximately 91.5 dBA which is capable of causing permanent hearing loss. The sampling was performed for 331 minutes during one work shift on October 25, 2013. The noise level exceeded a dose of 50% and no hearing conservation program was in place at the time of the exposure. e. On or about October 25, 2013, an employee who was working in the production area was exposed to noise levels at 78.7% of the allowable 8 hour time weighted average sound level (85 dBA). The equivalent level of the 78.7% is approximately 91.3 dBA which is capable of causing permanent hearing loss. The sampling was performed for 320 minutes during one work shift on October 25, 2013. The noise level exceeded a dose of 50% and no hearing conservation program was in place at the time of the exposure. f. On or about October 25, 2013, an employee who was working in the production area was exposed to noise levels at 66.2% of the allowable 8 hour time weighted average sound level (85 dBA). The equivalent level of the 66.2% is approximately 87.1 dBA which is capable of causing permanent hearing loss. The sampling was performed for 477 minutes during one work shift on October 25, 2013. The noise level exceeded a dose of 50% and no hearing conservation program was in place at the time of the exposure.
