Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of drowning while working aboard the bait barge and skiff:    a. Bait barge - On or about 10/29/13, and at times prior thereto, personal flotation devices (PFD) were not provided by the employer.     b. Skiff - On or about 10/29/13 and at times prior thereto, personal flotation devices (PFD) were not provided by the employer.    c. Bait barge - On or about 10/29/13, and at times prior thereto, U.S. Coast Guard approved life rings with at least 90 feet of line was not provided by the employer.    d. Bait barge - On or about 10/29/13, and at times prior thereto, rescue ladders were not provided by the employer.    e. Bait barge - On or about 10/29/13, and at times prior thereto, hoses and flexible cables were not organized to prevent tripping hazards in walkways.    AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE METHODS TO CORRECT THE HAZARD WOULD BE TO FOLLOW THE PROVISIONS OF OSHA regulations 29 CFR 1915.73(e), 1915.91(a), and 1915.158(a) as well as US Coast Guard regulations 33 CFR 175.15:  1. When employees are working near the unguarded edges of decks of vessels afloat, they shall be protected by personal flotation devices, meeting the requirements of 1915.158(a).  2. Provide at least one PFD for every person aboard a recreational vessel of the following type: (1) Type I PFD; (2) Type II PFD; or (3) Type III PFD.   3. When work is being performed on a floating vessel 200 feet (61 m) or more in length, at least three 30-inch (0.76 m) U.S. Coast Guard approved ring life buoys with lines attached shall be located in readily visible and accessible places. Ring life buoys shall be located one forward, one aft, and one at the access to the gangway. On floating vessels under 200 feet (61 m) in length, at least one 30-inch (0.76 m) U.S. Coast Guard approved ring life buoy with line attached shall be located at the gangway. At least 90 feet (27.43m) of line shall be attached to each ring life buoy.   4. There shall be at least one portable or permanent ladder in the vicinity of each floating vessel on which work is being performed. The ladder shall be of sufficient length to assist employees to reach safety in the event they fall into the water.   5. Good housekeeping conditions shall be maintained at all times. Adequate aisles and passageways shall be maintained in all work areas. Hose and electric conductors shall be elevated over or placed under the walkway or working surfaces or covered by adequate crossover planks.
