29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a. On or about October 30, 2013, at the above addressed jobsite, employees using a pneumatic nail gun did not wear safety glasses, thereby exposing the employees to the hazards associated with eye injuries.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure: a. On or about October 30, 2013, at the above addressed jobsite, employees working from the 5/12 pitched residential roof were exposed to falls of approximately 20 feet due to the lack of a fall protection system.
