29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that was reasonably accessible in terms of time and distance to the worksite, which was available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not be available at the worksite to render first aid:   At the project on or about November 5, 2013, a person with first aid training was not always onsite, and the project was located more than four minutes from medical facilities. The safety officer said he had first aid training three years ago, but he was not always onsite. Employees used circular saws to cut wood for formwork at the project.

The first aid supplies were reportedly in the foreman's truck, and the foreman was not always onsite. Employees used circular saws to cut wood for formwork at the project.

29 CFR 1926.150(a)(4): All firefighting equipment was not periodically inspected and maintained in operating condition. Defective equipment was not immediately replaced:   At the project on or about November 5, 2013, and at times prior thereto, a fire extinguisher was not charged. It was the only fire extinguishing method onsite. There were paper, rags, and scrap lumber onsite. Potential ignition sources included defective electrical equipment, smoking and motor vehicles.

Vehicles and employees accessed the work site next to the backhoe.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support):   At the rear of the house on or about November 5, 2013, and at times prior thereto, the foot of a job made ladder, with a working length of 11.5 feet, was not 2.875 horizontal feet from the top support. The foot of the ladder was 6 horizontal feet from the top support. Employees used the ladder to access the 10.5 foot high roof of the structure to put in formwork and rebars.
