29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): The employer failed to protect employees from potential fall hazards associated with roofing operations on an existing residential apartment building where the ground to eave is greater than 6 feet and the roof pitch is more than 4:12. The most recent example of this was found on the job site located at 14449 Boyd Street, Omaha, NE 68116 where the employer had employees re-roofing an existing residential apartment complex that was three stories high without being protected against fall hazards. Instances include but are not limited to: i. Employees on the roof more than 6 feet from the ground wearing fall arrest harnesses that are tied off to nothing. ii. Employees on the roof more than 6 feed from the ground and there is no catch platform in place.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: The employer failed to provide employees with fall protection training necessary to identify the hazards associated with roofing an existing residential apartment complex with a roof height over 6 ground to eave and pitch greater than 4:12. The most recent example of this was found on the job site located at 14449 Boyd St. Omaha, NE 68116 where the employer had employees roofing an existing residential apartment complex with ground eave heights over 6 and roof pitch greater than 4-12 without having been trained on recognizing fall hazards.
