29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. At the project on November 5, 2013, gloves with nirile palm sides and cotton mesh back sides were used instead of gloves made of nitrile or butyl material while mixing portland cement with water and using portland cement to lay CMUs.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: At the project site on November 5, 2013, there were no rebar caps on numerous rebars that protruded about 3 to 24 inches from concrete masonary units (CMU) at the back wall. Employees were observed working above rebars, thus exposing themselves to impalement hazards.
