No written hazard communication program was in place for employees cutting, grinding and polishing silica containing materials such as but not limited to granite.

No material safety data sheet for silica was in place for employees cutting, grinding and polishing silica containing materials such as but not limited to granite.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  For employees working in the fabrication area of Nature Stone Solutions, located at 1712 Seeds in Sarasota (FL), as observed on or about 11/21/2013:    a) For the employee exposed to noise at 147% of the permissible daily noise exposure limit (8-hour time-weighted-average level 0f 85 dBA), or an equivalent sound level of 91 dBA during the 423 minute sampling period.  This exposure calculation included a zero increment for the 57 minutes not sampled.    b) For the employee exposed to noise at 90% of the permissible daily noise exposure limit (8-hour time-weighted-average level 0f 85 dBA), or an equivalent sound level of 91 dBA during the 430 minute sampling period.  This exposure calculation included a zero increment for the 50 minutes not sampled.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) For employees fabricating granite tops at 1712 Seeds Ave., Sarasota, FL 34234, as noted on or about 11/21/2013.  Employees were required by employer to wear an N95 dust mask in fabrication bay without a written respiratory protection program with site specific procedures in place. No mask fit test and medical evaluation was conducted prior to use of N95 dust mask being used by employees.
