29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that was reasonably accessible in terms of time and distance to the worksite, which was available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not be available at the worksite to render first aid: At the project on or about November 8, 2013, the foreman and owner said no one had first aid training and the nearest medical facility was more than four minutes away. Employees used 6 and 8 foot step ladders.

29 CFR 1926.50(g): Where the eyes or body of any person was exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: At the project on or about November 8, 2013, and at times prior thereto, there was no eyewash onsite or a hose to connect to the faucet to flush eyes for 15 minutes. Employees used products with warning labels that said to flush eyes with large amounts of water or for 15 minutes in the event of eye contact and to obtain medical attention. The products included the corrosive DAP White Fast Dry Acrylic Latex Caulk Plus Silicone.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: At the project on or about November 8, 2013, hand protection and eye protection were not worn while using Top Industrial No. 200 Superior Rubber Caulk, BASF Sonolastic NP1 High Performance Polyurethane Sealant, DAP White Fast Dry Acrylic Latex Caulk Plus Silicone, and Klean Strip Lacquer Thinner. The warning labels on the BASF Sealant said it was an eye and skin irritant and a carcinogen. The warning labels on the DAP Caulk said to wear gloves and safety glasses, to flush eye with large amounts of water in the event of contact, and it was a carcinogen. The warning labels on the Klean Strip Lacquer Thinner said to avoid contact with the eyes and skin, to flush with water for 15 minutes in the event of eye contact and to get medical attention, and it was a carcinogen. The Future World corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.95(a), which was contained in OSHA inspection number 476158, citation number 1, item number 1, and was affirmed as a final order on April 15, 2013, with respect to a workplace located at The Mama Sandy Road, Tract 2022, Lot 7-Ri, Barrigada, Guam.
