29 CFR 1926.652(d)(2): Manufactured materials and equipment used for protective systems were not used and maintained in a manner that would have prevented employee exposure to hazards. a) Clearfield Street and Frankford Avenue - Employees installing a pipeline in a trench approximately six (6) to nine (9) feet deep, four (4) foot nine (9) inches wide and thirty (30) feet long were exposed to cave-in hazards as the Safe-T-Shore hydraulic aluminum shoring was not used in accordance with the manufacturer's specifications. Observed on or about November 5, 2013. b) Clearfield Street and Frankford Avenue - Employees installing a pipeline in a trench approximately six (6) to nine (9) feet deep, four (4) foot nine (9) inches wide and sixty-nine (69) feet eight (8) inches long were exposed to cave-in hazards as the Safe-T-Shore hydraulic aluminum shoring was not used in accordance with the manufacturer's specifications. Observed on or about November 6, 2013.

29 CFR 1926.652(c)(2)(iii): Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations were not in written form at the jobsite during construction of the protective system. a) Clearfield Street and Frankford Avenue - The Employer did not have the Safe-T-Shore hydraulic aluminum shoring specifications at the jobsite during construction of the protective system. Employees were installing a pipeline in a trench that was approximately six (6) to nine (9) feet deep, four (4) foot nine (9) inches wide and thirty (30) feet long. Observed on or about November 5, 2013. b) Clearfield Street and Frankford Avenue - The Employer did not have the Safe-T-Shore hydraulic aluminum shoring specifications at the jobsite during construction of the protective system. Employees were installing a pipeline in a trench that was approximately six (6) to nine (9) feet deep, four (4) foot nine (9) inches wide and sixty-nine (69) feet eight (8) inches long. Observed on or about November 6, 2013.
