29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: a) On or about November 1, 2013, 1st Priority Roofing, LLC. as the controlling and exposing employer, did not ensure that its own employees and the employees of Amaya's Roofing, LLC., a subcontractor were protected from falls while working at heights greater than 6 feet. A 1st Priority Roofing, LLC. employee and five employees of Amaya's Roofing, LLC. were exposed to fall hazards in excess of 8 feet while engaged in roofing activities on the roof of a residential building with no fall protection in place. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: a) On or about November 1, 2013, 1st Priority Roofing, LLC. as the controlling and exposing employer, did not ensure that portable ladders, used to access upper landing surfaces, extend at least 3 feet above the upper landing surface to which the ladders were used to gain access. Workers were observed using a ladder to access the roof of a residential building. Ladder did not extend at least 3 ft above the landing platform and was not tied to the roof edge. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
