29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: On or about November 8, 2013, and times prior thereto the employer did not ensure electrical equipment used at a commercial construction site was used as per the equipments listed and labeling: 1. At the front North West side outside of the construction project, a job made extension cord, in use, was made using an extension cord and a metal junction box with knockouts to supply electrical power to employees performing HVAC installation work inside of the construction project. 2. At the front North West side outside of the construction project a 120V power strip was used outside to supply power to battery chargers.

29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites.
