29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.    a)  On or about November 6, 2013 at the worksite at the front of the building; one employee was working in an aerial lift, at or above 25 ft. high, without using a personal fall arrest system.      b)  On or about November 6, 2013 at the worksite at the rear of the building; one employee was working in an aerial lift, at or above 25 ft. high, without using a personal fall arrest system attached to the aerial lift basket.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of personal fall arrest systems, guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.    On or about November 6, 2013 at the worksite at the front of the building; one employee was working in an aerial lift, at or above approximately 12 ft. high from the roof top below, without his personal fall arrest harness and lanyard properly connected to each other.
