OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a. Marble and other stone slabs were being removed from inside closed containers by a forklift. Employees would go inside the container to remove the wood bracing around the slabs while standing in the fall zone of the slabs exposing employees to crushing hazards.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees a. In the warehouse, there were three Abaco Lifters, that were below-the-hook lifting devices that were attached to an overhead crane's hook that were used to lift slabs of granit and other material approximately 800 to 1000 pounds. The lifting device did not have an identification plate or any other means to indicate the lifting device's lifting capacity, therby exposing the employees to a struck-by or caught-between hazard.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. In the warehouse, the employer allowed employees to lift slabs of material by slings attached to tines of a CAT forklift without prior written approval from the forklift manufacturer. The use of the slings below the tines can change the capacity and safe operation of the forklift.
