OSHA Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to crushing injuries while operating equipment such as, but not limited to, a roller compactor: At the future site of the United Independent School District Bus Depot, an employee operated a 2006 Bomag compactor roller. Employees were exposed to hazards such as, but not limited to being thrown or falling from the compactor as a result of the compactor not being equipped with a functional seatbelt.

29 CFR 1926.95(a): Protective equipment was not used wherever it was necessary by reason of hazards of processes or environment: At the future site of the United Independent School District Bus Depot, employees operated a 2006 Bomag compactor roller and did not use a seatbelt. Employees were exposed to injuries in the event of a vehicle accident/incident.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On November 13 2013, at this jobsite, an employee was operating a Bomag compactor roller on a dirt road to a construction site without prior instruction in recognizing and avoiding unsafe working conditions which could be caused by the compactor operation. The employee was exposed to crush-by hazards.
