29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: On or about January 21, 2016, an employee was exposed to a struck-by hazard, by a Soil Roller while the employee operated the Sakai, model: SV540, Chassis No: 3SV53-10302, without using the seatbelt while compacting soil. Jerry Resendez Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSHA Section (5)(a)(1), which was contained in OSHA inspection number 948260, citation number 1, item number 1/a and was affirmed as a final order on September 23,2014, with respect to a workplace located at 9603 Hwy 359, Laredo, TX 78045.
