On or about November 13, 2013 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to scaffolding and falls.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  a.  On or about November 13, 2013 - at the above addressed jobsite, employees using a ladder jack scaffold were not trained to recognize the hazards associated with the use of such scaffolds, thereby exposing the employees to the hazards associated with falls.

29 CFR 1926.300(a): Condition of tools. All hand and power tools and similar equipment, whether furnished by the employer or the employee, shall be maintained in a safe condition.  a.  On or about November 13, 2013, at the above addressed jobsite, a skill saw was observed to be missing a cord plug and was hot-wired in to the extension cord, thereby exposing a employee to the hazards associated with power tools and electrical shock.

29 CFR 1926.405(g)(1)(ii): Attachment plugs for cords. If used as permitted in paragraphs (g)(1)(i)(C), (g)(1)(i)(F), or (g)(1)(i)(H) of this section, the flexible cord shall be equipped with an attachment plug and shall be energized from a receptacle outlet.  a.  On or about November 13, 2013 - at the above addressed jobsite, the flexible cord used to supply power to the skill saw was not equipped with an attachment plug, thereby exposing the employee to electrical hazards.

Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.  a.  On or about November 13, 2013 - at the above addressed jobsite, employees were conducting siding installation from a ladder jack scaffold approximately seventeen (17) feet above the ground that was not designed by a qualified person, thereby exposing the employees to fall hazards.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  a.  On or about November 13, 2013 - at the above addressed jobsite, employees conducting siding installation from a ladder jack scaffold approximately seventeen (17) feet above the ground were not provided with an access ladder, thereby exposing the employees to fall hazards.

On or about November 13, 2013 - at the above addressed jobsite, employees conducting siding installation from a ladder jack scaffold approximately seventeen (17) feet above the ground were not protected from falls by the use of a personal fall arrest system, thereby exposing the employees to fall hazards.
