29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  On or about 11/15/13, at the above addressed job site, the employer did not have a written hazard communication program while employees used chemicals such as Poly-Flo (could cause pneumonitis), Dioctyl Phthalate (could cause irritation, nauseas and cancer), and PVC (possible carcinogen by presence of VCM).

29 CFR 1910.1200(h): Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(1) and -2 on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced:  On or about 11/15/13 at the above addressed job site, the employer at the above addressed job site, did not provide hazard communication training to all employees who were working with respirable dust and additives such as PolyFlo, and Dioctyl Phthalate.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:   On or about November 15, 2013 at the above addressed jobsite, the employer did not provide the information contained in the appendix D to employees using a 3M half-face respirator during production processes at the facility.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   On or about 11/15/13 at the above addressed job site, the employer did not provide a medical evaluation nor fit testing to employees using a 3M half-face respirator during plastic processes at the facility.
