OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards when utilizing steel storage racks that were damaged, not anchored and not marked with the maximum capacity rating.  a) At American Vinyl Company, located at 6715 North 53rd Street TAMPA, FL:  On or about February 1, 2024, the employer exposed workers to struck-by and collapse hazards, in that the employer continued use of storage bays of the metal racking system where the framing was not anchored, had been damaged and were not marked with the maximum storage capacity rating.

29 CFR  1910.134(c)(2)(i):  The employer did not provide respirator users with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible.  a) At American Vinyl Company, located at 6715 North 53rd Street TAMPA, FL:  On or about February 1, 2024, the employer exposed employees to respiratory hazards, in that the information in Appendix D to 29 CFR 1910.134 was not provided to employees that were voluntarily wearing disposable N-95 respirators, full-face and half-face HEPA respirators while mixing powders near the five mixing hoppers and the auger mixer.
