Note: The requirements applicable to construction work under this paragraph are identical to those set forth at �1910.178(l) of this chapter.  On or about November 5, 2013:  (a) Employee operating a rough terrain forklift had not been evaluated in the safe operation of forklifts since 2007.

29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph.  On or about November 5, 2013:  (a) Employees were exposed to fall hazards over an approximately 30 feet, while working from a scaffold system that was not properly tied back to the structure at the prescribed height. Scaffold in use had a base height of five feet, in where scaffold system should have been tied back to structure at approximately 20 foot in height mark.

29 CFR 1926.452(c)(4): End frames of tubular welded frame scaffolding were not locked together vertically by use of pins or equivalent means in areas where uplift could occur:  On or about November 5, 2013:  (a) Employees were exposed to fall hazards over approximately 30 feet while working from a scaffold system applying stucco material. The scaffold system that was being used was not properly pinned to prevent uplift from occurring, when material was placed on scaffold system by a rough terrain forklift.
