29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. At the project site on November 14, 2013, eye protection was not used while mixing and applying portland cement with water.

29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, shall be guarded to eliminate the hazard of impalement. At the front of the project on November 14, 2013, there were no rebar caps on numerous rebars that protruded about 8-24 inches from the foundation of the front retaining wall. Employee were observed working above rebars, thus exposing himself to impalement hazards.
