OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   a)  TM Industrial Supply - On or about November 15, 2013, employees were potentially exposed to struck-by hazards from potentially defective below the hook lifting devices due to the lack of a below the hook lifting device inspection program.  Below the hook lifting devices including, but not limited to, the Lucker Lifting Clamp were not incorporated into an inspection program.  The below the hook lifting device were utilized for activities that included, but were not limited to, lifting and transferring flat, metal stock to the saw table in the saw department.

29 CFR 1910.305(g)(1)(iv)(A): Flexible cords and cables were used as a substitute for the fixed wiring of a structure:   a) hydro-pressure testing area, on or about November 15, 2013, extension cords were used in lieu of permanent wiring.  Multiple extension cords and a three-way power-tap were taped to the worktable.  The extension cords were strung along the back of the worktable and plugged in to an outlet mounted on the building support beam.
