OSH ACT of 1970 Section (5)(a)(1):  Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazards:  (a) Roof Truss System - on or about November 14, 2013 - the employer did not install the requisite lateral bracing for the wood roof trusses.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) North Side of the Building, Second Story Floor - on or about November 14, 2013 - employees were erecting the roof trusses without any conventional fall protection.  Ground to the top plate of the second story floor elevation was approximately 20 feet.
