29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee(s) ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) On or about November 25, 2013, Western Architectural Iron Company did not provide a medical evaluation to determine employee(s) ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace.  Employees utilizing a full-face 3M respirator with P100 filters were exposed in their workplace to contaminants including, but not limited to: toluene, xylene, acetone, and ethylbenzene.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:  (a) On or about November 25, 2013, Western Architectural Iron Company did not select respirator cartridges based on the respiratory hazard(s) to which the worker(s) were exposed.  The employer provided 3M P100 filter cartridges when employees were utilizing solvent based primer during painting operations.  Employees were exposed in their workplace to contaminants including, but not limited to: toluene, xylene, acetone, and ethylbenzene.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:  (a) On or about November 25, 2013, Western Architectural Iron Company did not ensure respirators were stored to protect them from damage, contamination, and damaging chemicals.  Employee(s) stored a full-face 3M respirator in an open top box inside the paint booth.  The respirator was not stored in a bag or container to protect it from contamination.  Employees were exposed in their workplace to contaminants including, but not limited to: toluene, xylene, acetone, and ethylbenzene.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(f)(5)(i): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein:  (a) On or about November 25, 2013, Western Architectural Iron Company did not ensure that each container of hazardous chemical(s) was labeled, tagged, or marked with the identity of the hazardous chemical(s) contained therein.  Secondary bottles such as Coke and Powerade bottles were used to distribute cutting oil in the workplace.  The bottles were not labeled with the identity of the cutting fluid contained in the bottles (CLC 350 and 4430).  CLC 350 and 4430 coolant contains chemicals including, but not limited to: petroleum distillates, alkanolamines.  No abatement certification or documentation is required for this item.
