29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a.) On and before 12/4/2013, the company had not developed nor implemented a written Hazard Communication Program. Employees at the company are exposed to a number of chemicals, including but not limited to: * Ace Lacquer Thinner containing organic solvents such as Methanol, Acetone, Hexane, MEK and Xylene. These chemicals can cause damage to the skin, eyes, liver, kidneys, respiratory system and the CNS system. The liquid is extremely flammable; * Valspar 9624696DS NH Chassis Gray 6UC paint containing Acetone, Propane, Butane and Hexanol Acetate. These chemicals can cause eye, skin and lung irritation and CNS depression; * Case Akcela No. 1 Engine Oil containing Solvent-Refined heavy paraffinic petroleum distillates. This chemical can cause skin irritation; * and, Welding rods, steel components and other materials which can produce metal fumes and other contaminants during welding and cutting operations. Metal fume exposure can result in symptoms that vary depending upon the specific component of the welding fumes. Symptoms can include flu-like symptoms, dyspnea (breathing difficulty), cough, muscle pain, fever, chills and interstitial pneumonitis. Abatement Certification and Documentation is required.

On and before 12/4/2013, the company had not provided training to all affected employees regarding the location and means to obtain information on the Hazard Communication Program and Safety Data Sheets (SDS's). b.) On and before 12/4/2013, the company had not provided training to all affected employees regarding an explanation of the current labeling system and details of the Global Harmonization labeling requirements. Materials used on site include, but are not limited to: * Ace Lacquer Thinner containing organic solvents such as Methanol, Acetone, Hexane, MEK and Xylene. These chemicals can cause damage to the skin, eyes, liver, kidneys, respiratory system and the CNS system.
