29 CFR 1910.178(l)(1)(ii): 29 CFR 1910.178(l)(1)(ii):  The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck:  a) 822-36 N. American St, Philadelphia, PA - The employer did not ensure that the employee operating the Gehl DL-8H 42, Dynalift, material handler was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation. This hazard exposes the employees to struck-by/crushing hazards. This violation was observed on or about November 22, 2013.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure:  a) 822-36 N. American Street, Philadelphia, PA - The employees were working approximately 40 feet above the ground without the use of any personal fall arrest system, thus exposing the employees to a fall hazard greater than 6 feet. This violation was observed on or about November 22, 2013.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
