OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards while walking and working in the vicinity of moving vehicles and equipment.      a)  Worksite, 136 Spagnoli Rd. Melville NY - An employee was walking and working in the vicinity of moving vehicles and equipment while cleaning the back of a 100 cubic yard walking floor trailer.  The employee was not wearing a reflectorized vest and was struck by an 836H Landfill Compactor; on or about 12/9/13.    b)  Worksite, 136 Spagnoli Rd. Melville NY - An employee was walking and working in the vicinity of moving vehicles and equipment while cleaning the back of a 100 cubic yard walking floor trailer.  The employee was not wearing a reflectorized vest and was exposed to being struck by moving vehicles and equipment; on or about 12/30/13.    C)  Worksite, 136 Spagnoli Rd. Melville NY - An employee was removing a tarp from a 100 cubic yard trailer while walking and working in the vicinity of moving vehicles and equipment.  The employee was not wearing a reflectorized vest and was exposed to being struck by moving vehicles and equipment; on or about 3/25/13.        Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
