29 CFR 1910.119(e)(5): The employer did not establish a system to promptly address Process Hazard Analysis (PHA) findings and recommendations and did not resolve PHA recommendations in a timely manner. The employer does not ensure that 2009 PHA recommendations are resolved in a timely manner and does not establish a system that addresses PHA recommendations. The violation occurred in the Brookshire Grocery Company facility on or about December 5, 2013 and at times prior thereto, where the employer failed to establish a system to address 2009 PHA recommendations and failed to resolve 2009 PHA recommendations in a timely manner. This condition exposed employees to inhalation, fire, and explosion hazards from potential releases of anhydrous ammonia. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure that 2009 PHA recommendations are resolved timely manner and a system is established to address 2009 PHA recommendations.

29 CFR 1910.119(h)(2)(vi): The employer did not maintain a contract employee injury and illness log related to contractor's work in process areas. The employer does not ensure that contract employee injury and illness log related to work in the process areas is maintained. The violation occurred in the Brookshire Grocery Company facility on or about December 5, 2013 and at times prior thereto, where the employer failed to maintain a contract employee injury and illness log related to the contractors work in the ammonia refrigeration area. This condition exposed employees to inhalation, fire, and explosion hazards from potential releases of anhydrous ammonia.
