29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Trench at North Niagara Tower, PPG Industries, Inc., 400 Park Drive, Carlisle, Pennsylvania - On December 5, 2013, an employee entered the south end of the trench, 67 feet long, 7 feet wide, with a depth of 5 feet, dug in Type B soil, to place a section of the new 10-inch water line. Part of the east wall at the south end of the trench had already collapsed and had additional tension cracks. Also, the soil had a high moisture content due to rainy conditions and due to water from the cooling water system leaking and running into the soil. A homemade shoring system consisting of two wood panels 16 feet long and 4 feet wide, laid length-wise, with one panel on the east wall and one panel on the west wall at the south end of the trench, with two Dayton telescopic support braces placed one above the other across the width of the trench and at the middle of the two wood panels, constituted the only cave-in protection in the trench. This homemade support system did not comply with paragraph (c) in that a registered professional engineer did not design and approve the support system and no tabulated data existed for the system, exposing employees to the hazard of a cave-in. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(4): Ladders were not used for the purpose for which they were designed: (a) Trench at North Niagara Tower, PPG Industries, Inc., 400 Park Drive, Carlisle, Pennsylvania - An employee used a Werner 8-foot fiberglass stepladder in the closed position to access the trench, exposing the employee to the hazard of falling to a lower level, on or about December 5, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
