29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a. Entire facility - On or about December 11, 2013, the employer had not implemented an energy control program for employees who perform servicing and maintenance on such equipment as the Eagle crushing and screening equipment. Employees were thereby exposed to the hazards associated with the unexpected energization of equipment.

29 CFR 1910.184(e)(3)(i): A thorough periodic inspection of alloy steel chain slings was not made on a regular basis and/or were done at intervals greater than once every 12 months: a. Crusher Area - On or about December 11, 2013 employees were required to use alloy steel chain slings while performing concrete block unjamming operations. The alloy steel chain slings were not inspected on a thorough periodic basis for damage and defects thereby exposing employees to struck-by hazards while performing unjamming operations.

Screen discharge conveyor area - On or about December 11, 2013, the underside of the inclined discharge conveyor belt was not guarded. Employees were thereby exposed to hazards associated with unguarded belt systems.
