29 CFR 1910.95(d)(1): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer shall develop and implement a monitoring program: a. On or about October 21, 2014, at the above located workplace, an employee was exposed to continuous noise at 213.2 percent of the permissible daily dose level, when measured with a 80 dB threshold, or equivalent sound level of approximately 95.34 dbA for the 434 minute sampling time. Exposure calculation included a zero increment for the 46 minutes not sampled. The employer had not developed and implemented a representative monitoring program.

On or about October 21, 2014, at the above located workplace, an employee was exposed to continuous noise at 213.2 percent of the permissible daily dose level, when measured with a 80 dB threshold, or equivalent sound level of approximately 95.34 dbA for the 434 minute sampling time. 29 CFR 1910.134(e)(1): General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator: a. On or about July 29, 2014, at the above located workplace, employees conducting stone crushing operations were not provided with medical evaluations prior to donning tight fitting half-mask respirators, thereby exposing employees to the hazards associated with respirator use.
