29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  a) At the establishment, employees assigned to shovel sludge residue from the granodizer waste tank in preparation for the disposal of the waste tank, were exposed to contact and inhalation hazards created from the sludge. The employer had not assessed the hazards of the job and had not determined the personal protective equipment required to safely protect the employees.

29 CFR 1910.1200(g)(8): The employer shall maintain in the workplace copies of the required material safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access, microfiche, and other alternatives to maintaining paper copies of the material safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  a) At the establishment, employees assigned to shovel  sludge residue from the granodizer waste tank in preparation for the disposal of the waste tank, were exposed to contact and inhalation hazards created by the sludge. The employees requested material safety data sheets for the chemicals they were exposed to and were not provided the MSDSs by the end of the work shift.

29 CFR 1904.32(a): Basic requirement. At the end of each calendar year, you must:      29 CFR 1904.32(a)(1): Review the OSHA 300 Log to verify that the entries are complete and accurate, and correct any deficiencies identified;        a) On the OSHA Form 300A, "Summary of Work-Related Injuries and Illnesses" for 2013, case #6, that occurred on or about 06/18/13 and had been red lined on the corresponding OSHA 300 form had not been included in the summary for 2013. Chiropractic treatment was considered medical treatment for recordkeeping purposes.         b) On the OSHA Form 300A, "Summary of Work-Related Injuries and Illnesses" for 2013, case #8, that occurred on or about 08/14/13 and had been red lined on the corresponding OSHA 300 form had not been included in the summary for 2013. The late reporting of an injury or illness was not a valid reason for red-lining an injury/illness.      c) On the OSHA Form 300A, "Summary of Work-Related Injuries and Illnesses" for 2013, case #10, that occurred on or about 2/15/13 and had been red lined on the corresponding OSHA 300 form had not been included in the summary for 2013. The late reporting of an injury or illness was not a valid reason for red-lining an injury/illness.      d)  On the OSHA Form 300A, "Summary of Work-Related Injuries and Illnesses" for 2013, case #15, that occurred on or about 12/09/13 and had been red lined on the corresponding OSHA 300 form had not been included in the summary for 2013. The injured employee was given medication by the attending physician.
