29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):     a)  Building #4, 2nd floor, front balcony, left of stairway:  On or about December 23, 2013, and at times prior thereto employees were exposed to a fall greater than 6 feet to the dirt ground below, while working near improperly installed guardrails .  The employer failed to perform regular inspections of guardrail systems and correct hazards, such as but not limited to: top guardrail installed at a height of approximately 48 inches and mid rail installed at height of approximately 28 inches.      b)  Building #4, 2nd  breezeway:  On or about December 23, 2013, and at times prior thereto employees were exposed to a fall greater than 6 feet to the dirt ground below, while working near improperly installed guardrails.  The employer failed to perform regular inspections of guardrail systems and correct hazards, such as but not limited to: top guardrail installed at a height of approximately 56 inches and a midrail installed at a height of approximately 25 1/2 inches.

29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a)  Building #4, 2nd floor, front balcony, left of stairway:  On or about December 23, 2013, and at times prior thereto employees were exposed to a fall greater than 6 feet in height to the dirt ground below, while working near improperly installed guardrails, that had top rail installed at approximately 48 inches and mid rail installed at approximately 28 inches.  The employees were not instructed on the guardrail installation requirements such as but not limited to guardrail heights.     b)  Building #4, 2nd  breezeway:  On or about December 23, 2013, and at times prior thereto employees were exposed to a  fall greater than 6 feet to the dirt ground below, while working near improperly installed guardrails, that had top rail installed at approximately 56 inches and mid rail installed at approximately 25 1/2 inches. 29 CFR 1926.502(b)(2):  Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high:  a)  Building #4, 2nd floor, front balcony, left of stairway:  On or about December 23, 2013, employees were exposed to a fall greater than 6 feet to the dirt ground below, from guardrails, mid rails, that were installed at a height of approximately 28 inches.  b)  Building #4, 2nd  breezeway:  On or about December 23, 2013, employees were exposed to a fall greater than 6 feet to the dirt ground below, from guardrails, mid rails, that were installed at a height of approximately 25 1/2 inches.
