29 CFR 1926.1000(b): Material handling equipment manufactured on or after September 1, 1972, was not equipped with rollover protective structure(s).    (a) Spooky Nook Sports Complex - The employer allowed the operator to use a New Holland EH35-B (N5TN61315) track hoe excavator with the rollover protection removed to dig sewer and water trenches in the new restroom facility near the field hockey pitch on or about December 27, 2013.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
